Introduction
For the purposes of these Terms and Conditions, "The Promoter" refers to New Eagle International Pty Ltd T/A Umart Online. The "Prize" refers to one (1) "MSI GeForce RTX 5090 32G Ventus 3X OC Graphics Card".
Participating in the competition means agreeing to these competition terms and conditions. The competition is being run by "The Promoter".
If there is any inconsistency between these Terms and Conditions and anything else that refers to this Campaign, these Terms and Conditions will prevail.
Eligibility to Enter
The competition is open to entrants over 18 years of age and located within Australia. Employees, contractors and their immediate families are excluded from the draw.
By entering the competition, you confirm that you are eligible to do so and that you are eligible to receive any prizes that may be awarded to you. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. There is a limit of one entry per person, and the competition is open to anyone who purchases any select MSI Monitor from Umart Online during the promotion period. Orders that are cancelled will be disqualified from entry.
The Promoter will not be held liable for any failure to receive entries and takes no responsibility for any lost, delayed, illegible, corrupted, damaged, incomplete, or otherwise invalid entries.
Entry period
The promotion period begins at 10 am AEST on 9 Oct 2025. All purchases must be completed by 11:59 pm AEST on 31 Oct 2025.
The Promoter will not be held liable for any failure to receive entries and takes no responsibility for any lost, delayed, illegible, corrupted, damaged, incomplete, or otherwise invalid entries.
The Prize
The winning prize is one (1) "MSI GeForce RTX 5090 32G Ventus 3X OC Graphics Card".
The prize is non-transferable and non-exchangeable, and no cash alternatives will be provided.
We reserve the right to substitute prizes of equivalent value if circumstances beyond our control require doing so.
The Promoter's decision is final. No correspondence will be entered into.
Winner Announcement
The winners will be drawn randomly and notified via the email address provided on 7 Nov 2025.
The Promoter will make two attempts to contact the winner via email.
If the winner does not respond to the emails informing them of their win within 5 (five) days of the second email, they forfeit their right to the prize, and the Promoter reserves the right to select and notify a new winner.
The winner's name and social media username may be posted on the Promoter's social media profiles after the winner has been selected.
Delivery of the Prize
The winner will allow 14 days for the prize to be delivered; otherwise, alternative collection or delivery arrangements can be made through mutual agreement. You may be responsible for covering any reasonable costs related to the delivery to your location.
Data Protection and Publicity
You agree that any personal information that you provide when entering the competition will be used by the Promoter for the purposes of administering the competition and for the other purposes as specified in our Privacy Policy.
All entrants may request information on the winning participant by submitting a ticket https://www.umart.com.au/support/form.
If requested by the Promoter, the winner agrees to release their first name and place of employment to any other competition participants.
The winner's first name will be announced on the Promoters website and social media channels.
Limitation of Liability
To the extent permitted by applicable law, The Promoter's liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question.
To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
General
The Promoter reserves the right to cancel the competition or amend these terms and conditions at any time and without prior notice.
In the event of unforeseen circumstances beyond The Promoter's reasonable control, the Promoters reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
